By accessing or purchasing from Toyz Boyz (toyzboyz.com.au), you agree to be bound by these Terms of Service. Please read them carefully before placing an order.
1. General These terms apply to all visitors, customers, and users of this website. We reserve the right to update or modify these terms at any time without prior notice. Continued use of the site constitutes acceptance of the current terms.
2. Eligibility By using this site, you confirm that you are of legal age in your jurisdiction to enter into a binding agreement, or that you have parental/guardian consent to do so.
3. Products Toyz Boyz specialises in die-cast model cars and related collectibles. All products are sold as collectibles and are intended for display purposes. They are not toys and may not be suitable for children under 14 years of age due to small parts.
Product descriptions, scales, and images are provided in good faith and are as accurate as possible. Minor variations in colour, finish, or packaging may occur between production runs and are not considered defects.
4. Pricing & Orders All prices are listed in Australian Dollars (AUD) and are inclusive of the 10% Australian Goods and Services Tax (GST) unless otherwise stated. We reserve the right to correct pricing errors and to cancel or refuse any order placed at an incorrect price. An order confirmation email does not constitute acceptance of your order — acceptance occurs when your order is dispatched.
5. Payment Payment is required in full at the time of purchase. We accept payment via the methods listed at checkout. All transactions are processed securely.
6. Shipping & Delivery We ship domestically and internationally. Estimated delivery times are provided as a guide only and are not guaranteed. Risk of loss passes to the buyer upon handover to the carrier. All parcels are photographed prior to dispatch as part of our record-keeping process.
7. Returns & Refunds Returns and refunds are governed by our separate [Return & Refund Policy], which forms part of these Terms. We do not accept change of mind returns. Australian Consumer Law rights are not excluded by these terms.
Pre-orders are subject to a 15% cancellation fee if a cancellation is approved after the order has been placed. By placing a pre-order, you acknowledge and agree to the cancellation terms outlined in our Refund Policy. Cancellations due to change of mind are not accepted.
8. Intellectual Property All content on this website — including product images, descriptions, logos, and branding — is the property of Toyz Boyz or its licensors. You may not reproduce, distribute, or use any content without prior written permission.
9. Limitation of Liability To the maximum extent permitted by law, Toyz Boyz is not liable for any indirect, incidental, or consequential loss arising from the use of this site or the purchase of products. Our liability is limited to the value of the order in question.
10. Privacy Your personal information is collected and handled in accordance with our Privacy Policy. By using this site, you consent to the collection and use of your data as described therein.
11. Governing Law These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
